1. About these terms
These Terms & Conditions govern use of the website and communication services provided by Thakares Digiweapons Pvt Ltd. By purchasing, accessing or using services, the Client accepts these terms. The Company may revise the terms from time to time; the published version is the version in force.
2. Services
Services include DLT-registered Bulk SMS (transactional, service-implicit, service-explicit and promotional), Transactional and Promotional RCS, Bulk Voice Calls/voice broadcasting/IVR, and Meta WhatsApp Business API access and platform subscriptions. Services are delivered through operator, aggregator and platform partners, including telecom operators, Google for RCS and Meta for WhatsApp.
3. Account, DLT registration and credentials
Clients sending messages in India must complete DLT registration, register their Entity, Sender ID (Header) and message templates, and keep them valid. Clients are responsible for the accuracy of submitted information, account activity and confidentiality of passwords and API keys.
4. Acceptable use
Users must not send messages to DND/NCPR numbers except where permitted under TRAI rules and consent records; unlawful, fraudulent, misleading, defamatory, obscene or infringing content; phishing, financial fraud, fake job offers, lottery, betting or unapproved loan/investment offers; messages without valid documented consent; or content violating TRAI, operator, Google or Meta policies. Proof of consent and prompt opt-out handling are required. The Company may suspend/terminate service for breaches and may share information with operators/authorities where required by law.
5. Delivery and service levels
Delivery depends on telecom operators, handset capability, network conditions, subscriber preferences and regulatory filters. The Company cannot guarantee delivery, delivery time or RCS support on every handset. If RCS cannot be delivered and SMS fallback is enabled, the applicable SMS rate is charged. Maintenance and events outside the Company’s control may interrupt service.
6. Rates, credits and payment
Published rates are in INR and exclusive of GST unless stated otherwise; the website rate cards show 18% GST. Services are prepaid unless a written credit arrangement is agreed. Credits are loaded after payment is received and realised. Rates may change following operator/partner revisions. Meta conversation charges and Google RCS charges, where applicable, follow those providers’ rates. Unless otherwise stated, message credits are valid for 12 months from purchase.
7. Refunds
Payments and message credits are governed by the Refund Policy, which forms part of these terms.
8. Intellectual property
The website, platform, software, documentation, trademarks and logos remain the Company’s property. Clients receive a limited, non-exclusive, non-transferable right to use the platform for their business messaging during the service term. Clients retain ownership of their content and contact data.
9. Liability
Services are provided on a reasonable-efforts basis. To the maximum extent permitted by law, the Company is not liable for indirect, incidental or consequential losses, including loss of profit, business or data. Total liability for a claim is limited to the amount paid for the specific service in the one month preceding the claim. Clients indemnify the Company for claims, penalties and costs arising from their content, consent records or breaches.
10. Suspension and termination
The Company may suspend or terminate services for non-payment, regulatory direction, operator instruction, suspected fraud or breach. Clients may stop using services at any time; sums already paid are handled under the Refund Policy.
11. Governing law
These terms are governed by the laws of India. Courts at Nashik, Maharashtra have exclusive jurisdiction, subject to any arbitration agreed in writing.
